Enforcement Notice Appeals

Enforcement Notices and Stop Notices can be served by Local Planning Authorities if planning laws are contravened.

If you put up a building or carry out a change of use without getting planning permission from the Local Planning Authority you may be breaking planning control rules. If you already have planning permission but do not meet the conditions attached to it, you are also breaking planning control rules.

It is not an offence to break planning control rules, however if your LPA decide that the building or use is not acceptable, they may decide to issue you with an Enforcement Notice.

In extreme cases the Local Planning Authority may issue a Stop Notice in conjunction with an Enforcement Notice requiring the unauthorised activities to cease before the Enforcement Notice becomes fully effective.

Under certain circumstances a Temporary Stop Notice may be served when there has been a breach of planning control and the LPA think that it is expedient that the activity is stopped immediately. Furthermore, it is an offence to fail to comply with a Stop Notice.

If you have received an Enforcement Notice or Stop Notice you should seek professional assistance as soon as possible.

Failure to act upon either an Enforcement Notice or Stop Notice could result in court action by the LPA leading to substantial fines.
